The Contest begins on February 18, 2008 and ends at 11:59 pm on May 11, 2008 ("Contest Period"). All times in these rules are Eastern Time Zone. All entries must be received during the Contest Period to be eligible.
ELIGIBILITY: Only residents of the 50 United States or Canadian residents (excluding residents of Quebec) over the age of majority in their jurisdiction of residence can enter, except for employees, agents, or representatives of American Greetings Corporation ("AG") or its subsidiaries, marketing and advertising agencies, Contest judges or any member of their immediate family. You are not authorized to participate in the Contest if you are not located within the United States or Canada.
HOW TO ENTER: To participate in the Contest, go to http://www.americangreetings.com/retailers/index.pd. There will be three greeting cards on the website, each consisting only of a picture without any text. First, register for the Contest by entering your name, e-mail address and other required information. Then, indicate which of the three cards you would like to submit a caption for and submit your caption for that card ("Caption"). There is a limit of 20 Caption entries per person.
Your Caption must: (i) consist only of the proposed text for the card; (ii) be an original work created solely by the individual listed in the registration page; and (iii) not have been previously submitted or used for any other commercial use or promotion. Captions cannot contain any trademarks or copyright material owned by a third party and you must, both at the time of entry into the Contest and at the time prizes are awarded, be the sole owner of all right, title and interest in the Caption (including copyright and moral rights).
JUDGING AND AWARDING OF PRIZE: The entries will be reviewed and judged by a team of AG staff ("Judges"). The criteria for judging of the Captions includes but is not limited to the following: humor, best captures the spirit and essence of AG's Fun Pix collection of greeting cards, adds to the variety of the Fun Pix collection and can be differentiated from AG's current cards.
The Judges will select one winning entry and two finalist entries around June 16, 2008. Entrants submitting the selected Captions will be contacted by e-mail. The decisions of the Judges shall be final and binding, and may not be challenged in any way. In the event that two or more entries contain the identical Caption (including punctuation) and are selected to win a prize, a random draw may be held amongst those who submitted the identical entries to determine who can win a prize. If a person selected to win a prize from the random draw is a Canadian resident, he/she must first correctly answer a mathematical skill-testing question to be awarded the prize. Your chances of winning depend on the quality of your Caption relative to the other qualifying Captions, as well as the number of entries in the Contest.
Except where prohibited, any entrant selected to be eligible to win a prize shall be required to sign an affidavit of eligibility, publicity and liability release, and a copyright transfer and release assigning all rights in the Caption to AG prior to receiving their prize. Any of the following events will disqualify an entrant from winning a prize and another entrant may be selected: (i) if AG cannot contact a selected winner within 30 days of initial attempt; (ii) if any required documentation is not returned within the time specified; (iii) if any entrant does not comply with the Contest rules; or, (iv) if the mathematical skill-testing question (applicable to Canadian residents only) is answered incorrectly.
By entering a Caption into the Contest, (i) entrants grant to AG an irrevocable, exclusive, paid-up, worldwide license to use, reproduce, translate, communicate, distribute, edit, adapt, copy and otherwise use all or any part of the Caption for any purpose relating to the Contest, for any other advertising or promotion or commercial use for AG, or on AmericanGreetings.com or its affiliate websites; and (ii) entrants waive their moral rights, if any, in and to their Caption in favor of AG and its assignees and licensees.
PRIZES: One Grand Prize will be awarded. The winning Caption will be printed on an AG greeting card and the Caption will also be featured on AmericanGreetings.com. The winner's name may be featured on the printed greeting cards. Additionally, the winner will receive $ 1000.00 USD. All amounts in rules refer to USD. Approximate Retail Value ("ARV") for the Grand Prize is $ 1000.
Finalist Prizes. Two finalist Captions will be selected. Each of the entrants who submitted a Caption selected to be a finalist will have their Caption featured on AmericanGreetings.com and will also receive a one year subscription to AmericanGreetings.com. ARV of each prize for finalist winners is $ 29.99.
Prizes must be accepted as awarded, are not transferable or convertible to cash, and cannot be substituted, subject to the following: AG, in its sole discretion, can substitute a prize for one of equal or greater value in its sole discretion. Winners are responsible for any applicable federal, state, or local taxes.
AG can also choose to post non-selected Captions on AmericanGreetings.com, along with the first name and city of residence of the entrants who submitted those Captions. These other Captions are not eligible for a prize.
GENERAL: Except where prohibited, acceptance of a prize constitutes consent to use the winner's name, likeness, comments, city of residence, and winning Caption for editorial, advertising, publicity and other commercial purposes without further compensation, in any media throughout the world in perpetuity.
AG reserves the right to cancel, terminate, or modify the Contest for any reason without notice, including infection by computer virus, bugs, tampering, unauthorized intervention, force majeure, or technical failures of any sort. AG also reserves the right to disqualify anyone tampering with the entry process, the operation of the website, or otherwise in violation of the rules, including if a non-compliant entry is submitted, or if entrant is attempting to undermine the legitimate operation of the Contest or is otherwise engaging in unfair, inappropriate or objectionable practices.
Entries that are late, lost, misdirected or incomplete for any reason including the failure or malfunction of any software, hardware, browser, or network failure, malfunction, congestion, or incompatibility, will not be eligible. AG is not responsible for any liability for injury or other damage, which may be due, directly or indirectly, in whole or in part, to participation in this Contest or the awarding of the prize. AG may not verify receipt of entries.
Entries shall be deemed to be submitted by the authorized account holder of the e-mail address associated with the entry. "Authorized account holder" shall mean the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Automated entries are prohibited, and any use of such automated devices will cause disqualification.
This Contest is subject to all federal, state, provincial and local laws. It is void outside the 50 United States and the District of Columbia and Canada, and where prohibited. The Contest is governed by the laws of the state of Ohio, without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of Ohio. All copies of entries submitted become the property of AG and will not be returned.
PRIVACY: Personal information will only be used to administer this Contest and otherwise as permitted or required by law and in accordance with the AmericanGreetings.com Privacy Policy and Terms of Service. By entering this Contest, entrant agrees that his/her Caption may be posted on AmericanGreetings.com, along with his/her first name and city of residence, without further notification.
