Official Rules for American Greetings x Lindt Chocolate Easter Basket Giveaway (the, “Giveaway”)
No Purchase Necessary to Enter or Win. A Purchase Will Not Increase Your Chances of Winning. Must have or open an account on Instagram to enter. Void where prohibited by law and outside of the United States (U.S.).

Sponsor:  The Giveaway is sponsored by American Greetings Corporation, One American Boulevard, Cleveland, Ohio 44145 (“Sponsor”).

Eligibility:  The Giveaway is open only to legal residents of the fifty (50) United States and the District of Columbia who are at the time of the Giveaway least 18+ (19+ in AL and NE; 21+ in MS) years old (the “Entrant”). Entrants must have or open an account on Instagram to participate in the Giveaway. Accounts are free and can be opened by visiting Instagram.com. Employees of Sponsor, Lindt & Sprüngli (USA) Inc., and subsidiaries and affiliates, as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees, its advertising and promotion agencies, and suppliers are not eligible to enter. Winning a prize is contingent upon Entrant fulfilling all requirements.  Sponsor reserves the right to verify eligibility.

Agreement to Official Rules: Giveaway is subject to these Official Rules, which will be posted and available using Sponsor’s Instagram handles @americangreetingsdigital and @amgreetings. Participation in the Giveaway constitutes an Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in connection with the Giveaway. All federal and state laws apply. Void where prohibited.

How to Enter:  The Giveaway begins April 9, 2025 at 9:00am EST and ends on April 14, 2025 at 11:59pm EST, all times and days are Eastern Time. (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible. Sponsor’s computer is the official time-keeping device for the Giveaway. To enter, simply: (a) Follow @americangreetingsdigital, @amgreetings, and @lindt_usa (b) Like the giveaway post; (c) Comment your favorite easter basket goodie. Unlimited entries – each tag/comment counts as an entry. Share to your story for an additional entry. Any attempt to use robotic, automated, programmed, bulk entries, or other illicit means or false information to enter the Giveaway will be disqualified.

Additional Entry Terms & Conditions: Use of computer programs and/or other automated devices to enter the Giveaway are prohibited. Normal Internet access and usage charges imposed by your on-line service will apply. By entering, you understand that a) the Sponsor has the exclusive right to use your entry and excerpts of your entry in any advertising and promotional materials (visual, sound, print and/or electronic form), including posting entries or portions thereof on its websites, social media accounts/pages, advertising. Etc.; b) you grant any and all necessary rights and licenses provided herein, including without limitation, all necessary copyright and other related rights to the entry, free and clear of all claims and encumbrances without violating the rights of any person or entity, including any right to privacy or publicity; and c) you hereby hold the Sponsor harmless from and against any third party claim arising from use of the entry and waive any right to inspect or approve uses of the entry or to be compensated for any such uses. All entries become the exclusive property of Sponsor and may not be acknowledged or returned. Proof of submission will not be deemed to be proof of receipt by Sponsor.

Drawing:  On or about April 15, 2025, Sponsor will select one (1) potential winner in a random drawing of all eligible entries received during the Entry Period. The odds of being selected depend on the number of eligible entries received. The potential winner will be notified via direct message by @americangreetingsdigital only. You must have followed all requirements for entry at the time of notice. The potential winner will be required to respond to the notice within 24 hours in order to win. If a potential winner doesn’t respond within this time, Sponsor may select an alternate potential winner. Sponsor will have no liability for a potential winner’s failure to receive notice due to spam, junk, or other security setting or potential winner’s provision of incorrect, incomplete, or non-working contact information.

Potential Winner Requirements: Except where prohibited, a potential winner may be required to complete and return a Declaration of Eligibility and Liability & Publicity Release within 5 days of being notified. If a potential winner fails to timely respond to the notification or to sign and return the required documents within five (5) day or is otherwise disqualified, they will forfeit the prize, and Sponsor may select an alternate potential winner in a random drawing of all remaining eligible entries received. Only three (3) alternate potential winners will be contacted, if time permits, after which any remaining prizes will remain un-awarded.

A winner is responsible for paying any applicable income taxes and any and all other costs and expenses not listed above. Any prize details not specified above will be determined by Sponsor in its sole discretion. A prize may not be transferred and must be accepted as awarded. You may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Sponsor in its sole discretion.

General Conditions:  In the event that the operation, fairness, security, or proper administration of the giveaway is impaired in any way, Sponsor may, in its sole discretion, either: (a) cancel or terminate the Giveaway; (b) modify or suspend the Giveaway to address the impairment and then resume the Giveaway; or (c) award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify and seek damages to the fullest extent of the law, from any individual who tampers with the entry process or operation of the Giveaway, violates these Official Rules, or acts in a disruptive or unethical manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication. By entering this Giveaway each Entrant: (a) agrees that the Sponsor has the right to contact the Entrant via direct message or the email address used to enter, or the contact information provided during winner verification in order to administer and fulfill this Giveaway; and (b) consents to the transfer of personal information for purposes of administration of the Contest and for such other purposes as Entrant may consent.

Release and Limitations of Liability:  By entering, to the fullest extent possible, Entrant agree to release the Sponsor, Lindt & Sprüngli (USA) Inc., Instagram, respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (collectively, the “Released Parties”) from any claim or cause of action that may occur, directly or indirectly, whether caused by negligence or not, from Entrant’s participation in the Giveaway or receipt, use or misuse of any prize, including, but not limited to: (a) unauthorized human intervention in any part of the Giveaway; (b) technical failure or network errors of any kind, including system, application, or software malfunction; (c) posting or printing errors; (d) lost, late, postage-due, misdirected, or otherwise undeliverable mail, email, or messaging; (e) errors in the administration of the Giveaway; or (f) injury or damage to persons or property. Entrant further agrees that in any cause of action, in no event shall the Released Parties be liable for attorneys’ fees or other legal costs. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

Privacy and Publicity:  Any information submitted as part of the Giveaway will used in accordance with Sponsor’s Privacy Policy. If you are a California resident, please refer specifically to Sponsor’s California Privacy Notice for additional information under applicable California privacy laws concerning collection of your information for the Giveaway. Except where prohibited by law, Winner grants to Sponsor, its subsidiaries and affiliates, retailers, agencies, and suppliers, the right and permission to use, publish, print, post, or broadcast, the Winner’s name, likeness, voice, opinions, biographical information, social handle, and state of residence for promotional, advertising, trade, or compliance purposes in any media without additional payment, consideration, permission, or notification.

Disputes and Governing Law:  Entrants agree that any disputes, claims, or causes of action arising out of, or connected with, the Giveaway shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Ohio. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, Entrant or Winner rights and obligations, or the rights and obligations of Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of Ohio, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Ohio.

Winner Information:  The Winner’s name (or social media handle) will be published by Sponsor after the end of the Giveaway or may be provided upon written request to Sponsor.
